The Committee of Ministers of the Council of Europe has come up with a resolution on the property issue in Albania. The CoE report confirms that the government-approved formula is effective. The Resolution states that Albania has achieved concrete results of high-level of political engagement to ensure the functioning of this mechanism. The Ministry of Justice also announces that compensation will be made within a time frame of no more than 10 years. The Committee of Ministers appreciates the concrete commitment of the Government to the fulfillment of the obligations of European Court decisions as well as the concrete measures taken to ensure the enforcement of the final court decisions.
The Committee of Ministers has assessed in this long and difficult process the cooperation of the Albanian authorities and those of the Council of Europe in the process of drafting and implementing the property compensation mechanism. During the discussions in the Committee of Ministers, Albania’s case was assessed by the Secretariat as a success story that guarantees the functioning of the European Court of Justice’s execution of judgments, maximizing the efforts and visible results that the Albanian Government has made to execute court.
In this way we finally resolve after 25 years the great problem of property compensation, having a compensation formula for the owners and an effective legal mechanism that allows owners to be indemnified, a mechanism already accepted and certified and with this decision of the Committee Ministers. The compensation of the owners is already guaranteed and according to the legal definitions will be realized within the 10 year legal deadline.
